隨著勞動市場轉型以及人口與家庭結構變遷，最近30年來持續湧現的關於收入與時間雙重貧窮的生命歷程困境與需要，成為當前福利國家改革的重大課題與挑戰。透過生命歷程觀點的研究取徑與制度分析架構，並引入無條件基本收入相互對話，本文提供一個拆解與理解現代人生命歷程時間赤字問題癥結的新視角，從「收入重分配」到「時間重分配」的制度邏輯關係建立，來超越僅企圖通過時間的重新配置以符合福利資本主義就業社會制度的思路框架，為現下生命歷程的制度改革開啟政策創新空間，也為當代基本收入的立論基礎與政治實踐開闢新局。傳統福利國家以建立在財力調查與職業階級的收入分配與社會安全保障，因應工業社會薪資勞動者家庭收入不足的生命風險

本論文題目「從言論自由論商標註冊事前審查權限之行使」，依此題目牽涉憲法、行政法及商標法，對象包含商標權利人、行政機關及消費者，然而衝突爭議點卻在於行政措施對於人民基本權利之限制，予與依憲法比對行政權限之合理界線應劃止於何處，又該以何種法理達到明確的依據，這即是本論文題目所要探討的內容。 商業競爭下的商標係為市場競爭而存在，固然需要由政府出面擬定規則，以維護交易秩序，但是並不需要直接就商標圖樣本身進行事前審查，除非它本身是不適格作為商標之身份，但可藉由形式審查之登記列冊程序就可排除，勿須以行政公權力提早介入私權間之競爭，而私權間之競爭時機點也應依商標的使用特性，係在於商標推出於市場實際使

用後才得以見分曉，此時被侵害之一方只要依照一般救濟途徑，直接訴諸司法機關審理，讓爭議雙方可循正當法律程序尋求解決之道，以顧及多方利益而不偏執。依目前申請商標時所採用的事前審查制度，因係採取「商標註冊主義」之故，以至於商標尚未於市場公開使用之前就必須先經由註冊程序審核通過後，才得以合法使用，也才得以受到法律之保障。然而，本文認為，當商標係牽涉人民基本權利言論的表現自由時就必須兼顧，而不宜再以行政管理為由，而包辦商標之存活，不但應限縮其行政權限於登記列冊之形式審核，並應僅就不適格作為商標之身分者預先排除，即屬完成一作為商標主管機關應盡之行政責任，餘事則交由商標權利人之間就實際使用後發生爭議，而由受

害一方自行追訴侵權一方，讓行政機關不致剝奪商標申請人之言論自由權益，以維護憲法保障人民言論自由、表現自由的基本權利。 本論文即是從商標事前審查之行政權限與言論自由之間如何達到合理性的平衡與限縮，而以相關之國內外判例及文獻，經由比較先進民主自由國家如何以其國家的憲法法律為基礎，明白作出不同的規定、不同的判決先例，尤其是指商標言論自由的案例研究上，不但期盼能提出真正存在的問題，並得以尋求解決該問題的方法，以對國家政經社會發展有所助益。
